By Using the Services rendered by Bizwin Softmass Technologies Pvt. Ltd. the Client agrees to comply with the following Terms of service.
1) SCOPE OF WORK:
a) SoftMass is only responsible for implementing the project as specified in interview and project description. If the customer wishes to make additional changes he should request an additional quote, otherwise he agrees to accept the result unless otherwise discussed and agreed upon.
b SoftMass has the right to set an extra price quote if the client wishes to make additional project changes which were not stipulated before and were not stated in the project description.
2) REFUND POLICY:
a.) SoftMass reserves the right to refund and cancel the project if the client asks for services which is a violation of copyright policies or other policies in force.
b.) SoftMass provides non-tangible, irrevocable goods and does not issue refunds after the product is delivered or uploaded to the client’s server.
3) DELIVERY:
SoftMass does not guarantee to complete development to schedule specified in Preliminary Terms of Delivery / Terms and Milestones. Breaks in production may happen because of customer’s activity (i.e. the client doesn’t Ansh Info Solutions all the data necessary for development/customization or is not contactable/Non responsive).
4) COMMUNICATION:
The client must communicate to all questions and queries of SoftMass and the respective project lead / Manager / Technical Staff within 2 business days.
5) ESCROW AND FUNDING OF MILESTONES:
a.) The client must fund at least one milestone escrow before the project and should escrow the next milestone amount once the previous milestone is achieved.
b.) Incase when the client fails to fund the escrow on time and fails to communicate or respond after 3 consecutive reminders from SoftMass. The project will be closed and no refunds regarding the previous payments / upfront will be refunded. Further no files / deliverables will be delivered to client’s server till full payment is realized.
6) INDEMNITY:
The client agrees to indemnify and hold SoftMass and its Affililiate Companies, and their officers, agents, employees, partners, and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, OR your use of the Service. You also agree to hold SoftMass harmless in case of any delay in production/deployment of the above mentioned services/products.
7) PROPRIETARY RIGHTS:
The client fully understands, acknowledges and agrees that the Service and any necessary software used in connection with the Service contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Under all circumstances the client should abide by the policies and guidelines of such proprietary rights. In case of any violation of such policies by the client SoftMass will not be responsible for any such breach / violation.
